Constitution & By-Laws

Preamble

We, the law enforcement officers of the United States and the State of Nebraska, Sarpy County, as representatives do hereby associate the members we represent thereof together for the following purposes: To support and defend the Constitution of the United States; to inculcate loyalty and allegiance to the United States of America; to promote and foster the enforcement of law and order; to improve the individual proficiency of the members in the performance of their duties; to encourage social, charitable, and educational activities among law enforcement officers; to advocate and strive for uniform application of the merit system for appointment and promotion; to create a tradition of esprit de corps insuring fidelity to duty under all conditions and circumstances; to cultivate a spirit of fraternalism and mutual helpfulness among the members and the people we serve; to increase the efficiency of the law enforcement profession and thus more firmly to establish the confidence of the public in the service dedicated to the protection of life and property.

Article 1Organization
SECTION 1:

Name. This organization shall be known as the SARPY COUNTY LODGE #3 FRATERNAL ORDER OF POLICE and shall consist of all members who are admitted to membership and conform to its rules and regulations.

SECTION 2:

Name and Insignia. The rights to authorize, control, and restrict the use of name and insignia of the Order shall lie exclusively with the Board of Directors of the Grand Lodge and the Nebraska State Lodge.

Article 2Character
SECTION 1:

Nonsectarian Character. The Fraternal Order of Police is strictly nonsectarian and shall have no affiliation directly or indirectly with any labor union, congress, federation or committee of like nature or political action committee or similar organization by whatever name known.

SECTION 2:

No Strikes. The Fraternal Order of Police shall not strike or by concerted action cause a cessation of the performance of police duties or induce other members or other lodges to do likewise. The penalty for such action by any member shall be immediate expulsion from the Fraternal Order of Police, imposed in accordance with Article 33 of these By-Laws.

SECTION 3:

Governing Documents. The constitution shall be the fundamental law of the Order and, together with the by-laws enacted therewith and the Rituals adopted at National conferences, shall govern the conduct of the Lodge.

Article 3Membership
SECTION 1:

Eligibility. Any employee of the Sarpy County Sheriff’s Office, and any employee of the Sarpy County Emergency Communications Center in a position covered by a collective bargaining agreement for which the Lodge is the recognized bargaining representative, shall be eligible for membership in the Fraternal Order of Police Lodge #3 subject to the criteria for membership as determined by the Board of Directors of the Fraternal Order of Police Lodge #3 and in accordance with the constitution and by-laws of the National Fraternal Order of Police.

SECTION 2:

Subversive Organizations. The Fraternal Order of Police shall deny membership to anyone who is or has been a member of any party, regardless of what name known, which advocates the destruction of our government, either by force or subversive means.

SECTION 3:

Leaving Active Duty. Any member who resigns from active law enforcement duty with the department may, with the approval of the Board of Directors, maintain active membership provided that the member remains in "good standing."

SECTION 4:

Retired Honorary Members. "Retired Honorary Member" If a retiring member meets the Nebraska County Employee's Retirement System requirements and has ten years membership with Lodge 3, he/she may request approval from the Board of Directors to obtain status as a "Retired Honorary Member." Upon approval, the member will not be required to make any further payment of dues and will become eligible for the insurance benefits as described in Article 24, Section 1, with such member's premium to be paid by Lodge #3 according to Article 24. Retired Honorary Members are ineligible for voting in lodge business.

SECTION 5:

Active Honorary Members. "Active Honorary Member" With the approval of two-thirds of the "Board of Directors" a citizen, who is not otherwise eligible for membership in the Lodge, may be designated as an "Active Honorary Member." This member would be required to remain in "good standing" and pay for any and all benefit programs that he/she elected to participate in. An "Active Honorary Member" is not entitled to participate in voting any Lodge #3 business.

SECTION 6:

Honorary Members. "Honorary Member" With the approval of two-thirds of the "Board of Directors" a citizen, who is not otherwise eligible for membership in the Lodge, may be designated as an "Honorary Member." This designation is strictly a social title and does not entitle the member to any benefits whatsoever. This "Honor" shall be reserved for those individuals who have displayed a genuine support for Law Enforcement that is well beyond that of an ordinary citizen. Honorary Members are ineligible for voting in lodge business.

SECTION 7:

Good Standing. A "Member in good standing" is hereby defined to be a member who has paid all dues and assessments payable to the Lodge and who is not more than 30 days in arrears of such payment as of the date specified for payment thereof.

B. If such dues and assessments fall into arrears due to the member being called to active duty in the United States Military, the member shall not fall out of “good standing”. The member shall remain in “good standing” until they return from active duty. Once a member returns from active duty, they will have 90 days to reconcile the past due amounts. The Executive Board may, at their discretion, vote to waive the dues for the time the member was on active duty.

SECTION 8:

Eligibility for Office. Any "member in good standing" for a period of one year or more immediately preceding the holding of an election or who has met all other requirements of the Lodge By-laws provided shall be eligible for election to office.

SECTION 9:

Delinquency. Any member in arrears of payment of dues or assessments more than 30 days and less than 90 days shall be deemed to be delinquent and not in "good standing" for the purposes of dues, unless they fall under Section 7 (B).

SECTION 10:

Suspension for Non-Payment. Any member in arrears of payment of dues or assessments more than 90 days and less than 6 months shall be automatically suspended, unless they fall under Section 7 (B).

SECTION 11:

Reinstatement. Any member delinquent or suspended, as provided in Sections 9 and 10 of this Article, may be reinstated and restored to good standing by payment of all amounts due, and, in addition thereto, the payment of dues for the whole of the current year in which the reinstatement was made.

SECTION 12:

One Lodge Only. No person shall simultaneously be a member of more than one subordinate lodge.

SECTION 13:

Obligations of Membership. By taking the oath of the Order, or by applying for, accepting, or continuing membership in the Lodge, including the payment of dues, each member acknowledges and agrees to be bound by the Constitution, By-Laws, and Ritual of the Order and of the Nebraska State Lodge and the National Fraternal Order of Police, whether or not the member has taken the oath in person.

Article 4Officers
SECTION 1:

Officers. The officers of Sarpy County Lodge #3 shall consist of the following: President, Immediate Past-Presidents (not to exceed Two Immediate Past-Presidents), Vice-President, Second Vice-President, Secretary, Treasurer, One-Year Trustee, Two-Year Trustee, Three-Year Trustee, Chaplain, and Sergeant at Arms.

SECTION 2:

Eligibility. Only active non-retired members in good standing in Lodge #3 are eligible for Officer positions.

Article 5Board of Directors
SECTION 1:

Composition. The Board of Directors shall be composed of the President, Immediate Past Presidents (not to exceed Two Past-Presidents), Vice-President, Second Vice-President, Secretary, Treasurer, One-Year Trustee, Two-Year Trustee, Three-Year Trustee, Chaplain, and Sergeant at Arms.

SECTION 2:

State and National Officers. Any lodge member who holds an office within the State Lodge as President, Vice-President, Secretary, Treasurer, Trustee, State Labor Council President, National Lodge Trustee, or any National Lodge Board Member, shall also become a member of the Board of Directors of this Lodge. They will attend all meetings of the Board and will have the authority to make motions, second motions, and have all other powers and privileges afforded any other Board Members, except they will not be able to vote when a vote is called for by the President or Acting President at a meeting of the Board.

SECTION 3:

Powers. The Board of Directors shall have and exercise the administrative powers of the Order during the period between monthly meetings.

SECTION 4:

Forfeiture of Office. Any Lodge Officer or member of the Board of Directors who resigns from active police duty for any reason other than to retire on pension, either for length of service or disability, or otherwise becomes ineligible as a member of the Fraternal Order of Police shall automatically forfeit his or her office as a member of the Board of Directors.

SECTION 5:

Vacancies. Any vacancy in any office of the Lodge shall be filled by holding a Special Election in accordance with Article 21, Section 5, Nomination and Election of Officers of the Lodge.

SECTION 6:

Expenses. The expenses of the members of the Board of Directors or any other member appointed by the President to attend meetings of the Board and any other business of the Lodge shall be paid by the Lodge as directed by the President.

SECTION 7:

Removal for Absences. The President can remove any board member of the Order who has 3 unexcused absences in any calendar year. If such a removal occurs, the President will notify the Membership via email that the removal has occurred and that a special election will be held within three weeks of the vacancy being created.

SECTION 8:

Quorum. At all Board of Directors meetings, a quorum of six (6) members must be present to conduct votes on issues brought to the Board. If there is only one Past-President, a quorum of five (5) must be present to conduct votes on issues brought to the Board.

SECTION 9:

Spending Limit. The Board of Directors is empowered to authorize expenses up to $10,000 per expense. Any expense above $10,000 requires approval by the membership present at a regular business meeting. No expense shall be divided into smaller amounts to avoid this limit or the limit in Article 6, Section 3. Once a recurring contract or program has been approved, such as the term life insurance program under Article 24, legal counsel under Article 16, or the scholarship fund under Article 27, payments made under its approved terms shall not require separate approval. This includes scholarships awarded under Article 27, regardless of the total amount awarded in a given year. Any change that increases its annual cost by more than $10,000 shall be approved by the membership.

Article 6Duties of the President
SECTION 1:

Duties. The President shall be the Chief Executive Officer of the Order. He/She shall preside at the monthly meetings and the meetings of the Board of Directors. He/She shall have general management of the Order and shall see that all orders and resolutions of the Board of Directors are carried into effect.

The President shall:

  • A.Execute any and all contracts that may be authorized by the Board of Directors;
  • B.Be an Ex-officio member of all standing committees;
  • C.Have authority with the advice and consent of the Board of Directors to appoint any committee or committees to inquire into any affair or matter affecting or concerning the Order;
  • D.Call special meetings of the Board of Directors when he/she deems it necessary, or upon petition of a majority of the Board of Directors. The Lodge Secretary shall post notice of such meetings to the General Membership and each member of the Board of Directors at least 5 days prior to such meeting. If an emergency arises, the President can waive the requirement to post the notice.
  • E.At each session of the Board of Directors submit a full and complete report of the official business transacted by him/her subsequent to the last meeting of the Board, together with such recommendations as he/she may deem advisable.
  • F.Convey to his/her successor all unfinished business of the Order.
  • G.Together with the Secretary he/she shall attest all vouchers for disbursements from any fund of the Lodge.
SECTION 2:

Discretionary Authority. In certain instances, the President must exercise discretion and authority without the Board of Directors' approval. In such instance where a decision of this type is made, the President shall report the circumstances to the Board at the next regularly scheduled meeting.

SECTION 3:

Spending Limit. The President may authorize expenses up to $1,000 per expense. Expenses above $1,000 require approval by the Board of Directors or membership at a monthly business meeting.

Article 7Duties of the Immediate Past Presidents(Not to exceed two Immediate Past-Presidents)
SECTION 1:

Duties. The Immediate Past Presidents shall attend all meetings of the Board of Directors. They shall advise and assist the President and the Board of Directors in the performance of their duties and shall execute such assignments as may be ordered of them.

Article 8Duties of the Vice President
SECTION 1:

Duties. The Vice President shall, in the absence of the President, perform all duties normally performed by the President. He/She shall also perform other such duties as shall be ordered by the Board of Directors.

SECTION 2:

Additional Duties. The Vice President may perform tasks to aid in the proper function and interests of FOP Lodge #3 and the Board of Directors.

SECTION 3:

Acting for the President. The Vice President may, in consultation with the President, perform duties and functions that are normally reserved for the President. The President may authorize the Vice President to act on his/her behalf and exercise his/her authorities.

SECTION 4:

Monthly Financial Review. The Vice President shall review, together with the Treasurer, all bank, debit card, and credit card statements of the Lodge each month in accordance with Article 11.

Article 9Duties of the Second Vice-President
SECTION 1:

Duties. The Second Vice-President shall be required to schedule all part-time employment for commissioned law enforcement officers, as needed, in accordance with Article 34 of these By-Laws. He/She shall perform all other duties the President may require.

SECTION 2:

Off-Duty Administration. The Second Vice-President shall administer off-duty employment and maintain records in accordance with Article 34 of these By-Laws.

Article 10Duties of the Secretary
SECTION 1:

Duties. The Secretary shall have custody of the books, records, documents, seal of the Lodge, office paraphernalia and equipment under general authority and orders of the President and the Board of Directors. He/She shall take a record and transcribe minutes of all meetings of the Board of Directors and general business meetings, and shall submit the same for approval or rejection at the next succeeding meeting.

The Secretary shall:

  • A.Conduct the general correspondence of the Lodge.
  • B.Notify members of general membership meetings via email
  • C.Together, with the President, he/she shall attest all warrants or vouchers for cash disbursement from any fund of the Lodge.
  • D.Attest under the seal of the Order all duly authorized contracts of the Order.
  • E.Be the official custodian of the Constitution and By-laws of the Order, which shall be authenticated by the Seal of Order and the signatures of the President and Secretary.
  • F.Compile and post an agenda for all meetings of the Board of Directors and General Membership. The agenda shall be posted for at least 5 days prior to the meeting.
  • G.Maintain the Lodge's designated electronic means of communication and the electronic records of the Lodge.
  • H.At the expiration of his/her term of office and within 30 days thereafter, the Secretary shall deliver to his/her successor the Official Seal of the Order all books, documents, paraphernalia and equipment in his/her possession and shall require and receive a receipt thereof.
SECTION 2:

Membership List. The Secretary shall not release the mailing list of the names and addresses of members to anyone unless it has been with the consent of the Board of Directors. The Consent is to be entered into the minutes of the time of the meeting when so adopted by the Board of Directors. Notification of such consent shall be given to the members throughout the membership of the Sarpy County Fraternal Order of Police Lodge #3.

SECTION 3:

Misuse of Membership List. Any officer or member of the Fraternal Order of Police Lodge #3 who violates this section by giving the membership mailing list to anyone or he/she uses the membership list for any purposes other than official Fraternal Order of Police business shall be subject to charges under Article 33 of these By-Laws. If such charge is sustained, he/she shall be suspended from the Fraternal Order of Police for a period of not less than one year.

Article 11Duties of the Treasurer
SECTION 1:

Duties. The Treasurer shall be custodian of the funds of the Lodge. He/she shall sign all checks duly authorized by the President and the Secretary for disbursement of funds. He/She shall also maintain records of all transactions completed using debit/credit cards possessed to access the Lodge’s funds. Only the President and Treasurer shall possess and be authorized to use debit/credit cards owned by the Lodge unless a member was directly requested to fulfill a purchase for Lodge business.

The Treasurer shall:

  • A.Keep an itemized record of all receipts and disbursements.
  • B.Deposit all funds collected in a bank approved by the Board of Directors,
  • C.Set up special accounts for special funds and allocate to each respectively the amounts allocated or collected therefore.
  • D.Perform other such duties as are usual and incident to the office.
  • E.Make reports to the Board of Directors and general membership of the condition of the funds.
  • F.Review, together with the Vice-President, all bank, debit card, and credit card statements of the Lodge each month. The Vice-President shall initial or otherwise document each statement as reviewed.
  • G.At the expiration of his/her term of office and within 30 days thereafter, the Treasurer shall deliver to his/her successor all equipment in his/her possession and shall require and receive a receipt thereof.
Article 12Duties of the Board of Trustees
SECTION 1:

Composition. The Board of Trustees shall consist of the One-Year Trustee, who shall have been a member in good standing with the Order for at least one year; Two-Year Trustee, who shall have been a member in good standing for at least two years; and Three-Year Trustee, who shall have been a member in good standing for at least three years.

SECTION 2:

Duties. The Board of Trustees shall have charge of and be responsible for all property of the Order.

The Board of Trustees shall:

  • A.Take charge of the physical property of the Order.
  • B.Make a complete and itemized inventory.
  • C.Each December, update the inventory and file with the Board of Directors a certified copy thereof.
  • D.Conduct an annual audit each December of all funds and financial books and records of the Order for the calendar year, and present a written report thereon to the Board of Directors and the general membership at the January business meeting.
  • E.Ascertain that all monies received have been allocated to the credit of the proper funds and so deposited in the name credited of the Order.
  • F.Upon order of the Board of Directors, purchase any equipment or supplies as deemed necessary.
  • G.Annually, at the January business meeting, make full and complete report of all business transacted since the last annual report.
SECTION 3:

Accountant Review. The financial books and records of the Lodge, and its annual federal tax return, shall be maintained or prepared by a certified public accountant engaged by the Board of Directors. Whenever a new Treasurer takes office, and at any other time the Board of Directors so directs by majority vote, the Board shall engage a certified public accountant who is independent of the Lodge and of the accountant maintaining its books to review the financial books and records of the Lodge. The report of any such review shall be presented to the Board of Directors and made available to the membership.

Article 13Duties of the Chaplain
SECTION 1:

Duties. The Chaplain shall:

  • A.Keep the President informed of all members seriously sick or distressed.
  • B.Act as the liaison between the F.O.P. and any seriously sick or distressed member when that member or his/her family requests no visitors.
  • C.Provide the prayer at any formal activities.
  • D.Perform any other duties as directed by the President.
Article 14Duties of the Sergeant at Arms
SECTION 1:

Duties. The Sergeant at Arms shall have charge and control of the meeting place. He/She shall permit only qualified persons to enter or remain. He/She shall assist the Second Vice-President in the execution of duties as the President may order.

Article 15Committees
SECTION 1:

Standing Committees. The following Committees shall be established to focus on specific areas of interest of the Sarpy County FOP Lodge #3:

  • A.Social Media Committee
  • 1.A committee to promote the Lodge on social media platforms
  • B.E911 Communications Contract Committee
  • 1.A committee to represent the interests of E911 Communications members in contract negotiations
  • C.FOP Bylaws Committee
  • 1.A committee to ensure the Bylaws of the lodge are up-to-date
  • D.Non-Sworn Contract Committee
  • 1.A committee to represent the interests of Non-Sworn members in contract negotiations
  • E.Sworn Contract Committee
  • 1.A committee to represent the interests of Sworn members in contract negotiations
  • F.FOP Scholarship Committee
  • 1.A committee to oversee the FOP Scholarship award process
  • G.Participation Committee
  • 1.A committee to promote participation and inclusion of all members in Lodge business
  • H.Election Committee
  • 1.A committee to conduct elections and voting in the manners prescribed by the Constitution and Bylaws of the Lodge
  • I.Party-Planning Committee
  • 1.A committee to plan parties and social gatherings for members of the Lodge and their guests.
SECTION 2:

Committee Chairs. All committees shall be headed by a member of the Board of Directors.

SECTION 3:

Term of Service. Committee membership is a two-year commitment. Signing up for a committee occurs during the odd-numbered years that elections for Officers are held. Members may apply for a committee when submitting his/her ballot for the vote on Lodge Officers.

SECTION 4:

Confirmation. The Board of Directors will complete a vote confirming committee member lists at the first monthly Board of Directors meeting after the election.

Article 16Legal Counsel
SECTION 1:

Designation. There shall be a legal counsel designated by the President with the advice and consent of the Board of Directors. The President shall provide the contact information for the designated legal counsel to all FOP members on an annual basis.

SECTION 2:

Access to Counsel. Any member requesting the use of the Order's legal counsel may contact the designated Law Office or request the assistance of the President to contact legal counsel.

SECTION 3:

Additional Legal Funds. The Order’s agreement with the legal counsel provides a host of legal services at a flat rate. In the event funds are needed outside of the agreed upon rate schedule (i.e., expert testimony in defense of a member, etc.), such funds may be approved by a secret-ballot majority vote of the Board of Directors up to $10,000 per matter. Any amount above $10,000 shall require membership approval in accordance with Article 5, Section 9. The name of the member and the details of the matter shall be kept confidential in the minutes.

Article 17Amendments
SECTION 1:

Proposals. Any member of the Lodge in good standing, or the Board of Directors, may propose amendments to the Constitution and By-Laws. Such proposals shall be in writing, stating the proposed text and the reasons for the amendment.

SECTION 2:

Notice and Vote. A proposed amendment shall be submitted in writing to the Secretary at least 30 days prior to the business meeting. The Secretary shall post a copy of such proposed amendment, accessible to all members, at least 30 days prior to the meeting. The proposed amendment shall be submitted to a vote at the meeting. Upon a vote of two-thirds of the members present, or two-thirds of the votes cast in a ballot conducted under Article 20, Section 4, the proposed amendment shall become a part of the Constitution and By-Laws.

SECTION 3:

Effective Date and Publication. Unless otherwise stated in the amendment, an amendment shall take effect upon adoption. The Secretary shall attest each adopted amendment by signature, the Seal of the Lodge, and the date of adoption, and shall post the updated Constitution and By-Laws to the Lodge's designated electronic means within thirty (30) days.

Article 18Parliamentary Procedure
SECTION 1:

Robert's Rules of Order. Except as provided in the Constitution and By-laws, the latest edition of "Robert's Rules of Order" shall govern the conduct and deliberations of the meetings of the Board, the General Membership, and the Committees of the Order.

Article 19Official Ritual
SECTION 1:

Official Ritual. There shall be an official Ritual of the Order that shall be known as the Fraternal Order of Police Ritual.

SECTION 2:

Current Version. The Ritual of the Fraternal Order of Police, as most recently adopted or revised by the National Biennial Conference, shall be the official Fraternal Order of Police Ritual.

Article 20Official Order of Business
SECTION 1:

Order of Business. The order of business for the Sarpy County Fraternal Order of Police Lodge #3 shall include the following:

  • A.Roll call of officers
  • B.Presentation of minutes of previous meeting
  • C.Treasurer's report
  • D.Report on new members
  • E.President's report
  • F.Committee report
  • G.Old business
  • H.New business
  • I.Good of the Order
  • J.Adjournment
SECTION 2:

Voting. Except as otherwise provided in these By-Laws, any business conducted at the General Membership meeting requiring a vote shall be decided by the majority of members present.

SECTION 3:

Major Items. No vote shall be taken at a General Membership meeting on any of the following unless the item appeared on the agenda posted by the Secretary at least seven (7) days before the meeting:

SECTION 4:

Member Petition. Within ten (10) days after a General Membership meeting at which a vote was taken on an item listed in Section 3 of this Article, twenty-five (25) or more members in good standing may deliver a written petition, which may be made by email, to the Secretary requesting a vote of the full membership. Upon receipt of a valid petition, the decision shall be suspended and, within thirty (30) days, the Election Committee shall conduct an electronic ballot of all members eligible to vote, open for at least three (3) days, in accordance with Article 21. The vote required shall be the same as would have been required at the meeting, measured against the votes cast.

Article 21Nomination and Election of Officers of the Lodge
SECTION 1:

Nominations. Candidates for election as officers of the Lodge shall be nominated at the October business meeting of odd numbered years. Nominations may be made from the floor or by email to the Secretary or the Election Committee received before the close of that meeting. No nomination shall be placed on the ballot unless the nominee has accepted the nomination in writing, which may be by email, before the ballot is finalized. After being declared, nominations shall not be reopened. No member shall be nominated or be a candidate for election for more than one office at the same election. Each candidate for office of the Lodge shall be permitted to speak at the November business meeting prior to elections for a time not to exceed three minutes. Only the candidate himself/herself may be granted this privilege. Each candidate may also submit a written statement, not to exceed one page, which the Election Committee shall distribute with the ballot.

SECTION 2:

Election Committee. An Election Committee of not less than three (3) members shall be appointed by the President to distribute the ballots and canvass the votes. The Election Committee will conduct voting for a minimum of 3 days. All members in good standing with the lodge can vote. The Election Committee will audit those voting to ensure that a member does not vote more than once. After the polls are closed, this Committee shall count their votes, determine how many votes have been cast for each candidate, and shall report the results and declare elected those candidates receiving a majority of the votes for each respective office. No candidate for office, and no member of a candidate’s immediate family or household as defined in Article 35, shall serve on the Election Committee for that election. If a member of the Election Committee becomes a candidate, the President shall appoint a replacement.

SECTION 3:

Contract Ratification Votes. The Election Committee shall also be responsible for distributing the ballots and canvassing the votes when the membership is voting to accept or reject a proposed contractual agreement with the county. During such polling, the Election Committee shall monitor the vote to assure that only those members covered under the proposed agreement are allowed to cast a vote. The Election Committee shall report the results of all voting to the president of the lodge. If a proposed agreement is not accepted, the decision to declare impasse and seek other avenues for settlement, such as the commission of Industrial Relations, will require a vote of the entire General Membership, due to the large expenditures usually involved in such a matter. All meetings, motions and votes regarding expenditures shall be in accordance with the By-Laws of this lodge.

SECTION 4:

Installation. Installation of all officers shall take place at the regular business meeting in December of the odd year and shall take effect January 1 of the even year. Before assuming office, each officer shall take the oath of office of the Order, either in person at installation or by signing a written oath delivered to the Secretary.

SECTION 5:

Special Elections. A Special Election will be held in order to fill the vacancy of any office of the Lodge. A General Membership meeting will be called by the Board of Directors to be held no later than 2 weeks from the vacancy, at which meeting nominations will be accepted from the floor by the General Membership. The nominations will be posted, and within 30 days, a General Membership meeting shall be called in order for members to conduct a Special Election. All FOP members in good standing can vote. The Special Election shall be held in accordance to Article 21, Section 2.

SECTION 6:

Term of Special Election. The filled vacancy from the Special Election shall remain in effect until the next regular Nomination and Election of Officers of the Lodge is conducted, in accordance to Article 21, Section 1.

SECTION 7:

Electronic Voting. The Election Committee may employ the use of electronic methods to fulfill the duties of conducting any election or vote.

SECTION 8:

Voting Eligibility. Only active non-retired members in good standing may participate in elections and voting. Retired Honorary Members, Active Honorary Members, and Honorary Members are not eligible to participate in elections and voting.

SECTION 9:

Committee Sign-Up. A sign-up for committees shall accompany the biennial election ballot. If there is no ballot needed for the biennial election of officers, a sign-up shall still be sent to the membership.

Article 22Dues and Assessments
SECTION 1:

Dues. Effective August 30, 2012, each member of the Sarpy County Fraternal Order of Police Lodge #3 shall be assessed dues equal to 1.45% of his/her base wage. The dues shall be collected every two weeks through payroll deduction, and then be transferred to Lodge #3’s bank account.

SECTION 2:

Emergency Assessments. If two-thirds of the Board of Directors of the Lodge shall deem it necessary that the Treasury of the Order shall be increased to meet any emergency, they shall first determine the amount of assessment per member that would be required to cover estimated expenses. The Board shall then notify each member of the intentions of levying an assessment in a detailed account of probable expenditures.

Article 23Expenses and Compensation of Officers and Members
SECTION 1:

Expense Reimbursement. Any lodge officer or member performing the duties of or service for the Lodge by order of the Board of Directors or the President shall receive compensation for expenses required. Such officer or member shall furnish in duplicate to the secretary a detailed itemized statement of expenses incurred and paid by him/her in the performance of such duties or service and shall be reimbursed therefore by the Lodge.

SECTION 2:

Officer Compensation. Compensation to Lodge Officers shall be paid quarterly as follows, effective January 1, 2027:

  • A.President
  • 1.$2,175 per quarter
  • B.Vice-President
  • 1.$1,475 per quarter
  • C.Second Vice-President
  • 1.$1,475 per quarter
  • D.Secretary
  • 1.$1,125 per quarter
  • E.Treasurer
  • 1.$1,125 per quarter
SECTION 3:

Board Member Compensation. Effective January 1, 2027, each Immediate Past President, the One-Year, Two-Year, and Three-Year Trustees, the Chaplain, and the Sergeant at Arms shall receive $150 per quarter for each quarter in which he/she attends a majority of the regular meetings of the Board of Directors held during that quarter. An absence excused under Article 5, Section 7 shall be counted as attendance. Members serving on the Board under Article 5, Section 2 are not eligible.

SECTION 4:

Partial Quarters and Suspension. If an officer or Board member serves less than a full quarter, compensation for that quarter shall be prorated based on the number of days served in office. No compensation shall be paid for any period during which the officer or Board member is suspended under Article 33 of these By-Laws. Compensation for any period of interim suspension under Article 33, Section 10 shall be withheld, and shall be paid in full if the charges are dismissed or not sustained, or forfeited if the charges are sustained. Compensation shall cease upon removal from office.

Article 24Term Life Insurance
SECTION 1:

Term Life Insurance. Each member of the Fraternal Order of Police Lodge #3 shall be covered by a term life insurance program. The insurance carrier is to be chosen at the order of the Board of Directors. The Board of Directors will review the insurance program on an annual basis to determine any changes in coverage, premium payment methods, and choice of insurance company or broker.

Article 25Michael A. Elman/Ryan E. Fawcett Award
SECTION 1:

Selection. Each year the President shall submit a list of nominees, received from the membership, to the Board of Directors for the Michael A. Elman/Ryan E. Fawcett Award. The Board shall vote by secret ballot on the winner of the Award. The member with the most Board votes shall receive the award at the Annual Lodge #3 Holiday Party.

SECTION 2:

Criteria. Those candidates for the Award must demonstrate the positive attitude and the dedication to the F.O.P., their Brothers and Sisters and the Sheriff’s Office that were displayed by these two Brothers while they were members of the organization. Those qualities the candidate should embody may include integrity, courage, professionalism and loyalty. Any nomination for the Award should include information relating to how the candidate demonstrates these values.

SECTION 3:

President Ineligible. The President shall not be eligible for the Award during his/her term of office.

SECTION 4:

Presentation. In the event an annual holiday party is not able to be held, the President shall arrange the presentation of the award to the recipient to occur in the first quarter of the following year.

Article 26Selection of Delegates
SECTION 1:

Delegates. Nominations of voting delegates to the State and National Conventions will be accepted from any member in good standing within the F.O.P. Lodge. The President shall select the delegates, with special consideration given to current Board Officers. The President's selections are subject to final approval by the Board of Directors.

Article 27Scholarship Fund
SECTION 1:

Scholarship Fund. A scholarship fund will be established by the lodge to provide a scholarship of $1,000 to each qualifying applicant each year to members’ children or stepchildren for attendance at an accredited post-secondary institution, including a college, university, community college, or trade, technical, or vocational school, or a registered apprenticeship program. Scholarships awarded under this Article shall be paid from the scholarship fund without further Board or membership approval, regardless of the total amount awarded in a given year.

SECTION 2:

Application Period. It is the duty of the head of the Scholarship Committee to post the application process to the general membership by February 1 of the year the scholarships are being awarded. The application process will close on March 15 and the award decision will be made by April 15.

SECTION 3:

Scoring. The scholarships will be awarded by the Scholarship Committee based on a 10-point system. A minimum of 7 points is required in order to be eligible to receive a scholarship.

Five points based on cumulative GPA from high school or completed college semesters, on a 4.0 scale, with five points for 3.50–4.00, four points for 2.50–3.49, three points for 1.50–2.49, and zero points below 1.50.

Two-and-a-half points will be awarded based on community service, church activities or employment history, awarded as follows: two-and-a-half points for 40 or more documented hours of volunteer service or six (6) or more months of employment; one-and-a-half points for lesser documented service or employment; and zero points for none.

Two-and-a-half points based on social, or school activities, such as sports, music, elected positions, etc., awarded as follows: two-and-a-half points for two or more activities or a leadership role; one-and-a-half points for one activity; and zero points for none.

Each application shall include documentation supporting the points claimed, including an official transcript or other school-issued record showing the cumulative grade point average, and written verification of volunteer service hours, employment, or activities from the organization, employer, school, coach, or activity sponsor. Points shall not be awarded for any item that is not documented.

SECTION 4:

Eligibility and Payment. A scholarship can only be awarded to a person one time. A person may be eligible to apply during their senior year of high school or within four years after high school graduation or completion of an equivalent credential. Money will be deposited at the school or program in the student’s name for tuition, books, required tools or equipment, or room and board. Payment shall be made after the recipient provides proof of enrollment in the institution or program. If the recipient does not provide proof of enrollment within twelve (12) months after the award decision, the award shall lapse and the funds shall remain in the scholarship fund.

SECTION 5:

Recusal. Any member of the Scholarship Committee who is related by blood, marriage, or household to an applicant shall not participate in the review of applications for that year, and the President shall appoint a temporary replacement.

SECTION 6:

Scholarship Committee. The F.O.P. President, upon taking office, shall appoint a Scholarship Committee to serve a two-year term, coinciding with the term of that president. The Committee will consist of five people. One person, as elected by the five, will serve as chairperson and will hold all applications and information. The Scholarship Committee decision will be final, and is not subject to a grievance procedure concerning any portion of this article.

Article 28Police Memorial in Washington D.C.
SECTION 1:

National Police Week. The F.O.P Lodge will attempt to send representative members every May to Washington DC for a portion of National Police Week including the day designated as National Peace Officers Memorial Day. Only members in good standing are eligible to be sent, and the F.O.P. Lodge will only fund each eligible member once, to include travel, lodging, and per diem. The number of members sent will be determined by the President according to what the yearly budget allows. To be eligible, members must submit in writing their interest to the President each year, beginning July 1st, and selections will be made by the President on a first-come, first-serve basis. The President’s selections are subject to final approval by the Board of Directors. Members not selected to attend during the current year must resubmit their interest the following year to be considered.

Article 29Departure Gifts and Parties
SECTION 1:

Retirement Gift and Party. All members eligible for retirement in accordance with Article 3 are entitled to a retirement gift, as defined by Section 5 of this article, and retirement party to recognize his/her years of service and membership to Lodge #3.

SECTION 2:

Departure Gift. All members who have completed 10 years of membership in Lodge #3 or more, and who depart service with the Sarpy County Sheriff’s Office in good standing, shall be entitled to a gift as defined by Section 5 of this article.

SECTION 3:

Good Standing Defined. "In good standing," for the purpose of determining eligibility for a departure gift, shall mean an employee who separates from employment under circumstances that do not involve gross misconduct, significant breach of Sarpy County Sheriff’s Office policy, or conduct that has brought substantial discredit to the organization.

SECTION 4:

Board Review. If a member’s departure/retirement is believed to be not in good standing, a request can be made to the Board of Directors to discuss and vote on eligibility for a departure gift and/or funding for a retirement party.

SECTION 5:

Gift Amounts. The value of the departure gift presented to a member meeting the requirements of Section 1 or Section 2 of this Article shall be allotted as follows:

  • A.10-14 years of membership - $200 gift
  • B.15-19 years of membership - $400 gift
  • C.20-24 years of membership - $600 gift
  • D.25-29 years of membership - $800 gift
  • E.30+ years of membership - $1,000 gift
SECTION 6:

Retirement Parties. Retirement parties may be organized for members who have 20 years or more of membership to FOP Lodge #3 and meet the requirements of retirement in Article 3. The spirit of the retirement party is to bring all Lodge members together in fellowship to pay respects to the retiring member.

SECTION 7:

Party Allotment. Retirement parties will have a maximum allotment of $2,000 per member. If a member elects to not have a FOP-hosted retirement party, the member may instead choose to donate $500 of the allotted retirement party funds to a charity/non-profit organization of their choice. The remaining allotted funds not donated shall not be dispersed and will remain in Lodge funds.

Article 30Lodge Communications
SECTION 1:

Electronic Communication. Lodge business shall be accessible to the members by electronic means designated by the Board of Directors. The designated electronic means may be a Lodge website, a members-only portal, a secure shared electronic folder, electronic mail to the members, or any combination of these, and may be changed by the Board of Directors as the needs of the Lodge require. Access to Lodge records and to members-only material shall be restricted to members.

SECTION 2:

Access. All members wishing to receive communications from the Lodge shall provide and maintain with the Secretary a current non-County email address, and shall follow the instructions provided to gain access to the designated electronic means and any members-only areas.

SECTION 3:

Member Access to Records. Through the designated electronic means, the Lodge shall make the following available to members in good standing:

  • A.The current Constitution and By-Laws, including all adopted amendments;
  • B.The minutes of General Membership meetings, once approved;
  • C.The collective bargaining agreements to which the Lodge is a party; and,
  • D.Any notice or agenda required to be posted by these By-Laws.
SECTION 4:

Restricted Communications. Communications may be restricted solely to the designated electronic means and method of delivery to protect the interests of the Lodge and its members.

SECTION 5:

Administration. The Board of Directors may appoint a technician or other member to assist the Secretary in maintaining the designated electronic means and the electronic records of the Lodge.

Article 31Temporary Deviation from Collective Bargaining Agreements
SECTION 1:

Purpose. The Board of Directors recognizes that situations may arise in which strict adherence to the existing Collective Bargaining Agreement (CBA) may not be feasible, practical, or in the best interests of an individual member or of the Lodge as a whole. This section establishes the authority and procedure for approving limited deviations from such agreements.

SECTION 2:

Authority. By a majority vote of the Board of Directors present at a duly called meeting, the Board may authorize a temporary or case-specific deviation from the terms of the Collective Bargaining Agreement when such deviation is determined to be in the best interests of the affected member(s) or of the Lodge and when the creation of a formal addendum, memorandum of understanding, or amendment is not feasible, practical, or desired.

SECTION 3:

Scope and Limitations.

  • A.Any deviation approved under this Article shall not create a precedent or binding interpretation of the Collective Bargaining Agreement.
  • B.Deviations shall not conflict with applicable laws, regulations, or mandatory contract provisions required by statute.
  • C.The Board’s approval shall be documented in the meeting minutes, including a brief summary of the rationale and scope of the deviation.
  • D.The deviation shall expire upon completion of the specific purpose for which it was granted, unless otherwise extended by subsequent Board vote.
SECTION 4:

Notice. The Lodge President shall notify any affected member(s) and, where appropriate, the employer or relevant party of the approved deviation in writing within ten (10) business days of the Board’s decision.

Article 32Political Candidate Endorsements
SECTION 1:

Purpose. The Lodge recognizes that participation in the electoral process is an important means of supporting candidates who demonstrate values consistent with the mission of the Fraternal Order of Police. This Article establishes a fair and transparent process for evaluating and approving political candidate endorsements.

SECTION 2:

Requests. Requests for endorsement by candidates for public office may be submitted to the President or the Board of Directors. The President or Board may also extend invitations to candidates seeking endorsement.

SECTION 3:

Candidate Review. Upon receipt of an endorsement request, the Board of Directors may conduct a candidate review process which may include one or more of the following:

  • A.A written questionnaire addressing issues relevant to law enforcement, public safety and public sector unions.
  • B.A background or record review of the candidate’s public service and policy positions; and/or
  • C.An opportunity for the candidate to address the general membership at a scheduled meeting.
SECTION 4:

Vote. Following completion of any review, the endorsement shall be presented for a vote at a general membership meeting or a special meeting called for that purpose. A majority vote of the members present shall be required for approval.

SECTION 5:

Announcements. Only the President or a designated spokesperson authorized by the President may publicly announce or communicate any Lodge endorsement. No individual member or officer may represent or imply Lodge endorsement of any candidate without official approval as outlined in this Article.

SECTION 6:

Records. The Secretary shall ensure that minutes of the endorsement vote are recorded and archived as part of the Lodge’s permanent records.

SECTION 7:

Scope. This Article applies to all partisan and nonpartisan political offices for which candidates may seek endorsement from the Lodge.

Article 33Code of Conduct and Discipline
SECTION 1:

Purpose. In accordance with Article 23 of the Constitutions of the National Fraternal Order of Police and the Nebraska State Lodge, which require each subordinate lodge to develop and promulgate rules that provide for the fair and appropriate discipline of its members, this Article establishes the standards of conduct expected of all members of Sarpy County Lodge #3 and the procedure by which alleged violations shall be resolved. This Article shall be interpreted in such manner as to afford equity and fairness to all affected thereby.

SECTION 2:

Values. Every member of the Lodge, in his/her dealings with the Lodge and with fellow members, shall conduct himself/herself in keeping with the purposes set forth in the Preamble and the obligations of the Fraternal Order of Police Ritual. Members are expected to demonstrate integrity, courage, professionalism, and loyalty; to treat fellow members with dignity and respect; to act honestly as stewards of Lodge funds and property; and to cultivate a spirit of fraternalism and mutual helpfulness among the members.

SECTION 3:

Definitions. As used in this Article, the following terms shall be defined as follows:

  • A."Good Cause" shall mean nonfeasance, malfeasance, dishonesty, or any violation of the standards set forth in Section 4 of this Article.
  • B."Complainant" shall mean the member or members bringing a charge under this Article.
  • C."Respondent" shall mean the member against whom a charge is brought.
  • D."Hearing Board" shall mean the voting members of the Board of Directors, excluding any member disqualified under Section 9 of this Article.
  • E."Preponderance of the evidence" shall mean evidence which, when considered as a whole, shows that the fact sought to be proved is more likely true than not true. If the evidence on a charge is evenly balanced, the charge shall not be sustained.
SECTION 4:

Grounds for Discipline. Discipline may be imposed upon a member for any violation of the good of the Order, including, but not limited to, the following:

  • A.Violation of the Constitution, these By-Laws, the Ritual, oath or obligations of the Order, as accepted under Article 3, Section 13 of these By-Laws;
  • B.Acts of disloyalty to the Fraternal Order of Police, including, but not limited to, overt attempts to decertify the Fraternal Order of Police where the Lodge is the certified bargaining representative of its members, holding office in an organization which encourages members of the Fraternal Order of Police to leave the Order or which attempts to decertify the Order, or such other acts as bring disrepute, disgrace or dishonor upon the Fraternal Order of Police;
  • C.Distribution or use of the membership list in violation of Article 10 of these By-Laws;
  • D.The unauthorized use or the abuse of the name or insignia of the Fraternal Order of Police or the infringement of a trademark thereof;
  • E.Embezzlement, theft, misappropriation, or knowing misuse of Lodge funds or property;
  • F.Dishonesty or fraud in the conduct of Lodge business, including the falsification of Lodge records, ballots, or expense statements;
  • G.Harassment, intimidation, threats, or retaliation directed at a member because of that member's participation in Lodge business;
  • H.Conduct that willfully disrupts or obstructs Lodge meetings or elections, or interferes with the performance of the duties of Lodge officers;
  • I.Violation of Article 2, Section 2 of these By-Laws; and,
  • J.Conviction of a felony crime in any court of the United States, or any state court, once all appeals have been exhausted.
SECTION 5:

Scope and Limitations.

  • A.This Article governs the conduct of members as it relates to the Lodge and its members. The Lodge shall not use this Article to investigate or adjudicate matters that are the subject of Sarpy County Sheriff's Office policy or employer discipline, except where such conduct independently constitutes a violation of Section 4 of this Article or as provided in Article 34 of these By-Laws.
  • B.No member shall be disciplined under this Article for filing a grievance, requesting representation, lawfully expressing dissent or criticism of Lodge officers or decisions through Lodge channels, seeking or holding office, or voting.
  • C.Discipline imposed under this Article shall not diminish the obligation of the Lodge to fairly represent employees of the bargaining unit in matters arising under the Collective Bargaining Agreement.
  • D.Delinquency and suspension for non-payment of dues and assessments shall be governed by Article 3 of these By-Laws and not by this Article.
SECTION 6:

Penalties. Upon a finding that a charge has been sustained, the Hearing Board may impose one or more of the following penalties, which are listed in order of increasing severity:

  • A.Informal Resolution. With the consent of both the Complainant and the Respondent, the President may resolve a complaint through counseling or mediation at any time before a hearing. The resolution shall be documented but shall not constitute a record of discipline.
  • B.Written Reprimand or Censure.
  • C.Suspension. Suspension for a definite period not to exceed two (2) years. A suspended member shall not have voice or vote, shall not be eligible to hold office or serve on a committee, and shall not attend Lodge meetings for the period of the suspension. A suspended member shall retain the benefits provided under Article 16 and Article 24 of these By-Laws so long as he/she continues to pay all dues and assessments.
  • D.Removal from Office or Committee.
  • E.Expulsion. Expulsion shall terminate the member's membership in the Lodge and all rights and benefits thereof, including those provided under Articles 16, 24, and 29 of these By-Laws.

In addition to any penalty above, the Hearing Board may order restitution of any Lodge funds or property.

SECTION 7:

Complaints. Any member in good standing may file a complaint alleging a violation of this Article. The complaint shall:

  • A.Be made in writing and under oath, and be signed by the Complainant;
  • B.Be filed with the Secretary, or with the President if the complaint is made against the Secretary;
  • C.Be filed within one (1) year of the date on which the alleged conduct became known to the Complainant; and,
  • D.Provide such facts, including dates and the provisions alleged to have been violated, as may enable the Respondent to be fairly apprised of the nature of the charge.
SECTION 8:

Good Cause Review.

  • A.Within fourteen (14) days of receipt, the Secretary (or the President, as the case may be) shall serve a copy of the complaint upon the Respondent and shall distribute copies to each member of the Board of Directors.
  • B.The Respondent may, within thirty (30) days of receipt of the complaint, prepare a written response and serve it upon the Secretary (or the President, as the case may be), which response shall be distributed to each member of the Board of Directors.
  • C.At its next regular meeting following the response period, or at a special meeting called for that purpose, the Board of Directors shall determine by secret ballot whether there exists Good Cause to proceed. A majority vote of the members of the Board entitled to vote shall be necessary for a finding of Good Cause.
  • D.If Good Cause is not found, the complaint shall be dismissed and the Complainant and Respondent shall be so notified in writing. If Good Cause is found, the matter shall be set for hearing in accordance with Section 11 of this Article.
  • E.Any member who brings a complaint which is found to be brought frivolously or for personal gain shall, himself/herself, be subject to discipline under this Article.
SECTION 9:

Disqualification.

  • A.No member of the Board of Directors who is the Complainant, the Respondent, a material witness, related to either party by blood or marriage, or who has a personal interest in the outcome shall participate in the review, hearing, or decision of the matter.
  • B.If the President is disqualified, the Vice-President shall preside. If both are disqualified, the remaining members of the Hearing Board shall select a presiding officer from among themselves.
  • C.If fewer than six (6) members of the Board of Directors remain eligible to serve, the remaining members shall, by majority vote, appoint members in good standing who are not otherwise disqualified to serve on the Hearing Board for that matter only, so that the Hearing Board consists of no fewer than six (6) members.
SECTION 10:

Interim Suspension.

  • A.Where a complaint alleges a violation of Section 4(E), 4(G), or 4(J) of this Article, where the Respondent has been formally charged with a felony crime, or where the alleged conduct presents a risk to Lodge funds or to the safety of members, the Board of Directors may, by a two-thirds (2/3) vote of the members entitled to vote, suspend the Respondent's voice and vote, eligibility to hold office, attendance at Lodge meetings, and authority over Lodge funds pending the outcome of the hearing.
  • B.An interim suspension shall not affect the Respondent's membership or benefits and shall not constitute a finding that any charge is sustained.
  • C.An interim suspension shall expire automatically if a hearing has not commenced within sixty (60) days of its imposition, unless the Respondent requests or agrees to a continuance.
SECTION 11:

Hearing Procedure. In all disciplinary hearings conducted under this Article, due process shall be afforded the parties thereto, and the Hearing Board shall:

  • A.Ensure that the Respondent is served with written notice of the date, time, and place of the hearing, together with a copy of the complaint, by certified mail to his/her last known address and by email to the non-County email address on file with the Lodge, not less than thirty (30) days before the hearing;
  • B.Limit the scope of the inquiry to the specific complaint(s), charge(s), or allegation(s) set forth in the written notice thereof;
  • C.Adhere to an order of procedure which places the burden of proof upon the Complainant, who must prove the charge by a preponderance of the evidence;
  • D.Conduct the hearing in the following order:
  • 1.The Complainant shall present evidence in support of the charges;
  • 2.The Respondent shall then present such evidence as he/she may wish to offer in defense;
  • 3.The Complainant may offer evidence in rebuttal; and,
  • 4.Each party may make a closing statement.
  • E.Permit the parties to introduce documents and exhibits and the testimony of witnesses, and to question witnesses, in accordance with such rules of evidence as may be determined and applied uniformly by the presiding officer, who shall resolve all questions of procedure and evidence;
  • F.Permit each party to be accompanied and represented by a member in good standing or by an attorney at the party's own expense. The Lodge's designated legal counsel shall not represent either party but may advise the Hearing Board;
  • G.Conduct the hearing in closed session, attended only by the Hearing Board, the parties, their representatives, and each witness while testifying. The Secretary, or a member designated by the presiding officer if the Secretary is disqualified, shall keep a record of the proceedings; and,
  • H.Proceed with the hearing in the absence of any party who, after proper notice, fails to appear without good cause.
SECTION 12:

Decision.

  • A.Following the close of the hearing, the Hearing Board shall deliberate in closed session and shall vote by secret ballot.
  • B.A majority vote of the Hearing Board shall be required to sustain a charge and impose a written reprimand or censure. No suspension, removal from office, or expulsion shall be imposed except upon a three-fourths (3/4) vote of the members of the Hearing Board entitled to vote.
  • C.A written decision stating the findings and any penalty imposed, together with notice of the right to appeal, shall be served upon the Complainant and the Respondent within ten (10) days of the vote, in the manner provided in Section 11(A) of this Article.
  • D.At the next General Membership meeting following the decision, the President, or the presiding officer of the Hearing Board if the President was disqualified, shall read the following statement and shall say nothing further concerning the matter:

“Under Article 33 of the By-Laws, a disciplinary complaint was brought against [name of Respondent] and was heard by the Board of Directors on [date]. The Board found the charge or charges [sustained / not sustained]. [The penalty imposed is (penalty).] [No penalty was imposed.] [The Respondent has the right to appeal to the Nebraska State Lodge.] The evidence presented and the Board’s deliberations are confidential under the By-Laws and will not be disclosed. This matter is not before the membership for discussion or vote.”

The Secretary shall record the statement in the minutes as read. No officer or member of the Hearing Board shall provide additional information concerning the matter to the membership.

SECTION 13:

Charges Against Lodge Officers. Lodge officers shall be subject to discipline, including censure, reprimand, and removal from office or expulsion from the Order, only upon proof of Good Cause. A complaint alleging misconduct by a Lodge officer in the performance of his/her duties shall be processed in accordance with this Article, and the charged officer shall not participate as a member of the Hearing Board. No officer shall be removed from office except upon a three-fourths (3/4) vote of the members of the Hearing Board entitled to vote. Any vacancy created by removal shall be filled in accordance with Article 21, Section 5 of these By-Laws. Nothing in this Section shall limit the authority of the President under Article 5, Section 7 of these By-Laws.

SECTION 14:

Appeals. In the case of discipline imposed upon a member involving suspension, expulsion, or removal from office, an appeal may be taken by the member to the Nebraska State Lodge by filing a written notice of appeal with the State President not more than thirty (30) days after the member's receipt of official notification of his/her suspension, expulsion, or removal from office. Any further appeal shall be taken in accordance with the Constitution and By-Laws of the Nebraska State Lodge and the National Fraternal Order of Police. The discipline imposed shall remain in effect during the pendency of any appeal unless otherwise ordered by the State Lodge.

SECTION 15:

Reinstatement. A member who has been expelled under this Article may apply in writing to the Board of Directors for reinstatement not less than two (2) years after the effective date of the expulsion. Reinstatement shall require a three-fourths (3/4) vote of the members of the Board of Directors entitled to vote. The Board shall determine at the time of reinstatement whether any prior years of membership shall be credited for purposes of these By-Laws.

SECTION 16:

Records. The Secretary shall maintain all complaints, responses, notices, records of hearings, and decisions under this Article in a confidential file, which shall be part of the permanent records of the Lodge. Access to such file shall be limited to the Board of Directors and to the parties to the matter.

Article 34Off-Duty Employment
SECTION 1:

Purpose and Authority. The Lodge arranges off-duty and part-time employment for its members as a benefit of membership. The Second Vice-President shall administer all off-duty employment arranged by the Lodge in accordance with this Article, under the general authority of the President and the Board of Directors.

SECTION 2:

Eligibility. Only commissioned law enforcement members in good standing shall be eligible to sign up for or work off-duty assignments arranged by the Lodge. A member who is delinquent or suspended under Article 3, who is suspended or under interim suspension under Article 33, or who is barred from off-duty employment under Section 7 of this Article shall not be eligible for the period of such status.

SECTION 3:

Posting of Assignments. The posting of off-duty assignments shall follow these guidelines:

  • A.The posting shall be made as soon as practicable after the Second Vice-President has arranged the terms with the interested party or entity.
  • B.If an assignment is not filled within a reasonable amount of time, the Second Vice-President shall notify members again of the open assignment.
  • C.If the assignment is not filled within twenty-four (24) hours of the second posting, the assignment may be offered to officers of other agencies.
SECTION 4:

Sign-Up Rules. The Second Vice-President shall establish rules governing each sign-up period, which may include limits on the number of shifts a member may select, deadlines, and the order or manner of selection. Such rules shall be communicated to the membership in writing, by email or posting to the Lodge's designated electronic means, before the sign-up period opens, shall apply equally to all eligible members, and shall be binding for that sign-up period. Once a sign-up period has opened, its rules shall not be changed in a manner that restricts members, but may be relaxed, such as to release unfilled assignments. The Board of Directors may modify or rescind any such rule by majority vote.

SECTION 5:

Commitment and Replacement.

  • A.A member who accepts an off-duty assignment has committed to work it.
  • B.If the member becomes unable to work the assignment, it shall be the member’s responsibility to secure an eligible replacement and to notify the Second Vice-President of the replacement before the assignment begins. Upon such notice, the replacement member shall assume responsibility for the assignment.
  • C.Failure to work an accepted assignment, or to secure an eligible replacement, shall be a violation of this Article, except where the failure results from an emergency.
  • D.For purposes of this Section, an “emergency” shall include sudden illness or injury; a family emergency; being ordered to duty by the Sheriff’s Office, meaning a direct order from a supervisor or command officer requiring the member to report for duty at the time of the assignment (a voluntary or availability-based call-out, including call-outs for specialty teams such as SWAT or Crisis Negotiations, shall not qualify unless the member has been directly ordered to respond); military orders; or a similar circumstance beyond the member’s control, as determined by the Second Vice-President.
  • E.A member claiming an emergency shall notify the Second Vice-President as soon as practicable.
SECTION 6:

Standing Rules of Conduct. Every member signing up for or working a Lodge-arranged assignment shall:

  • A.Comply with the sign-up rules issued under Section 4 of this Article;
  • B.Not solicit or accept off-duty employment directly from any client, business, or entity with which the Lodge maintains an off-duty employment arrangement, so as to circumvent the Lodge’s scheduling, for as long as such arrangement exists;
  • C.Comply with Sarpy County Sheriff’s Office policy governing secondary employment; and,
  • D.Conduct himself/herself professionally, recognizing that performance on a Lodge-arranged assignment reflects upon the Lodge and its members.
SECTION 7:

Penalties. Violations of this Article shall be counted within any rolling twelve (12) month period, and the Second Vice-President shall impose penalties as follows:

  • A.First violation: a written warning.
  • B.Second violation: the member shall be barred from the next monthly sign-up period.
  • C.Third violation: the member shall be barred from all Lodge-arranged off-duty employment for three (3) months.
  • D.A fourth or subsequent violation, or any violation of Section 6(B) or 6(D) of this Article, may be referred to the Board of Directors as a complaint under Article 33 of these By-Laws, in addition to or in place of the penalties above.
  • E.Where a charge is sustained under Article 33, the Hearing Board may, in addition to any other penalty, bar the member from Lodge-arranged off-duty employment for a period not to exceed twelve (12) months.
SECTION 8:

Notice and Appeal.

  • A.Before imposing a penalty, the Second Vice-President shall give the member written notice of the alleged violation by email to the member’s non-County email address on file with the Lodge, and the member shall have five (5) days to respond.
  • B.The Second Vice-President’s decision shall be provided to the member in writing.
  • C.The member may appeal the decision to the Board of Directors by written notice to the Secretary within ten (10) days of receipt of the decision. The Board shall decide the appeal by majority vote at its next regular meeting, except that where the penalty is a bar under Section 7(B) or 7(C) of this Article, the President shall convene the Board of Directors to decide the appeal within fourteen (14) days of the Secretary’s receipt of the notice of appeal, which may be done by electronic means.
  • D.The penalty shall remain in effect during the appeal unless the Board orders otherwise.
SECTION 9:

Records and Fair Distribution. Off-duty employment shall be distributed by fair means. The Second Vice-President shall keep accurate records of the rules for each sign-up period and of all assignments, replacements, violations, and penalties. Such records shall be available for inspection by the Board of Directors at any time, and the Second Vice-President shall report a summary thereof to the Board of Directors quarterly.

SECTION 10:

Second Vice-President.

  • A.The Second Vice-President may work off-duty assignments only by signing up under the same published rules, limits, and timing as all other members, without advance or priority access. The Second Vice-President’s own assignments shall be shown separately in the quarterly report.
  • B.Any alleged violation of this Article by the Second Vice-President, and any matter in which the Second Vice-President has a personal interest or a family relationship with the member involved, shall be handled by the President in place of the Second Vice-President.
Article 35Conflict of Interest
SECTION 1:

Purpose. This Article protects the interests of the Lodge and the integrity of its decisions when a person acting for the Lodge has a personal or financial interest in a matter before it.

SECTION 2:

Definitions. As used in this Article:

  • A."Covered Person" shall mean any officer, member of the Board of Directors (including those serving under Article 5, Section 2), committee chair, or committee member.
  • B."Conflict of Interest" shall mean any matter before the Lodge in which a Covered Person, a member of his/her immediate family or household, or a business in which any of them holds an ownership, management, or employment interest, has a financial or personal interest that could reasonably be seen to affect the Covered Person's judgment.
  • C."Immediate family" shall mean a spouse or partner, parent, child, sibling, or grandparent, including step and in-law relationships.
SECTION 3:

Disclosure. A Covered Person shall disclose any Conflict of Interest to the presiding officer at the earliest opportunity, and in any event before the matter is discussed or decided.

SECTION 4:

Recusal. A Covered Person with a Conflict of Interest shall not take part in the discussion of or vote on the matter and shall not attempt to influence its outcome, but may answer factual questions if asked. The Covered Person may be counted toward a quorum.

SECTION 5:

Record. The Secretary shall record each disclosure, recusal, and the outcome of the vote in the minutes.

SECTION 6:

Questions. Where it is unclear whether a Conflict of Interest exists, the matter shall be decided by a majority of the disinterested members of the Board of Directors present.

SECTION 7:

Annual Statement. Each January, and upon taking office or appointment as a committee chair, each officer, member of the Board of Directors, and committee chair shall sign a statement affirming that he/she has read this Article, agrees to comply with it, and has disclosed any known Conflict of Interest. The Secretary shall keep the signed statements with the records of the Lodge.

SECTION 8:

Violations. Failure to comply with this Article shall be grounds for discipline under Article 33. Any transaction approved without a required disclosure may be reviewed by the Board of Directors and ratified or rescinded.

SECTION 9:

Relationship to Other Articles. Article 27, Section 5, Article 33, Section 9 and Article 34, Section 10 govern conflicts in those matters. This Article applies in all other matters.

Article 36Records and Dissolution
SECTION 1:

Retention of Records. The Secretary and Treasurer shall retain the records of the Lodge as follows:

  • A.Permanently: the Constitution and By-Laws and all adopted amendments; minutes of all Board of Directors and General Membership meetings; complaints, responses, hearing records and decisions under Article 33; and the Lodge's charter and tax-exemption documents.
  • B.For seven (7) years: financial records, including bank and card statements, receipts, vouchers, tax returns, and accountant reports; records kept under Article 34; and statements signed under Article 35.
  • C.For one (1) year after an election or vote, or until any challenge to it has been finally resolved, whichever is later: ballots and voting records.
SECTION 2:

Form and Custody. Records may be kept in electronic form. All records are the property of the Lodge and shall be delivered to the successor of any officer who holds them, in accordance with Articles 10 and 11.

SECTION 3:

Dissolution. Subject to the Constitution and By-Laws of the Nebraska State Lodge and the National Fraternal Order of Police, upon dissolution of the Lodge or revocation of its charter, and after payment of all debts and obligations, the remaining assets of the Lodge shall be distributed to the Nebraska State Lodge of the Fraternal Order of Police, or to one or more charitable organizations serving law enforcement officers or their families as designated by vote of the membership. No part of the assets shall be distributed to any member, officer, or other individual.
